TERMS OF SERVICE

1. AGREEMENT

By accessing or using Kadence ("the Service"), operated by app.kadence, a division of app.synerg, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. THE SERVICE

Kadence is an AI-native gamified productivity platform. The Service includes task management, productivity scoring, streak tracking, voice-based task capture, focus sessions, and related features accessible via web application at app.kadence.life.

3. ACCOUNTS

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 16 years old to use the Service.

One person or entity may not maintain more than one account. Accounts are non-transferable.

4. FREE TRIAL & BILLING

New accounts receive a 7-day free trial with full access to all features. No credit card is required to start a trial.

After the trial period, continued access requires a paid subscription at $5 USD per month. Payment is processed via Stripe. You may cancel at any time from your account settings.

If you do not subscribe after the trial, your account becomes read-only. Your data, score history, and profile are preserved indefinitely. You may resubscribe at any time to restore full access.

5. ACCEPTABLE USE

You agree not to:

• — Abuse, disrupt, or attempt to gain unauthorized access to the Service
• — Use the Service to transmit malware, spam, or illegal content
• — Scrape, crawl, or reverse-engineer the Service
• — Manipulate scoring, streaks, or achievements through automated means
• — Impersonate another person or entity

6. YOUR DATA

You retain ownership of all content you submit to the Service. We do not sell your data. You may export your data at any time in JSON or CSV format (GDPR Article 20).

You may delete your account and all associated data at any time from your profile settings. Deletion is permanent and irreversible.

7. AI FEATURES & VOICE DATA

The Service uses AI (Deepgram for voice transcription, Anthropic Claude for task extraction) to process voice input and extract structured tasks. Voice data is processed in real-time and is not stored by Kadence after processing.

By enabling the voice feature, you provide explicit consent under GDPR Article 6(1)(a) for real-time audio processing. You may withdraw this consent at any time by not using the voice feature.

AI-generated task suggestions are recommendations only and may be inaccurate. No automated decisions with legal or significant effects are made without your review and confirmation (GDPR Article 22).

8. AVAILABILITY

We aim for high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranty of any kind. We may perform maintenance or updates that temporarily affect availability.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, app.kadence and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service.

10. TERMINATION

We reserve the right to suspend or terminate accounts that violate these terms. You may terminate your account at any time by deleting it from your profile settings.

11. CHANGES

We may update these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance.

12. DATA PROCESSING

Your personal data is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). By using the Service, you acknowledge that your data is stored in the EU (Frankfurt, Germany) and may be processed by sub-processors in the USA under Standard Contractual Clauses (SCCs).

We maintain Data Processing Agreements (DPAs) with all sub-processors as required by GDPR Article 28. A full list of sub-processors and their purposes is available in our Privacy Policy.

13. GOVERNING LAW

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be resolved in the courts of Tallinn, Estonia.
